Bombay HC Reprimands Mira-Bhayandar Civic Chief Over Court Order Violation, Issues Show-Cause Notice

Mira-Bhayander, August 22, 2026: Taking a strong stance against deliberate court contempt, the Bombay High Court on Friday severely reprimanded Mira-Bhayander Municipal Corporation (MBMC) Commissioner Radhabinod Aribam Sharma and Assistant Director of Town Planning Purushottam M. Shinde for issuing a stop-work notice to a developer despite existing court protection.

Justice Ravindra Ghuge and Justice Gautam Ankhad expressed deep displeasure over the civic officials prioritising a local MLA’s instructions over judicial orders, questioning whether a politician's request ranks higher than a constitutional court order.
The bench drew a sharp parallel to a past contempt case where Karnataka’s Chief Secretary was sent to prison, warning officials of severe consequences for sidestepping judicial directions.
Commissioner Apologises
MBMC Commissioner Sharma apologised to the court, citing unawareness of the order, and assured the bench that the stop-work notice would be withdrawn and the matter reconsidered.
Upon the petitioner's counsel's request, the court refrained from initiating immediate contempt proceedings and instead issued a show-cause notice directing the officials to clarify their stance.
Developer Challenges MBMC Action
The contempt petition was filed by M/s Grandbuild Land Developers LLP. Senior Advocate Birendra Saraf, representing the developer, informed the court that despite a protective order issued on April 27, MBMC sent a letter demanding a halt to construction. Even after the developer formally requested MBMC to comply with court directives, the civic body persisted.

The High Court described the unfolding chain of events and the deliberate defiance of its explicit instructions which barred any adverse action as "shocking."
